TERMS AND CONDITIONS

These Terms and Conditions apply to the Game-U, LLC (“Game-U”) online platform offered at www.game-u.com and all lessons, classes, courses, and options offered by Game-U (“Courses” and altogether with the website, the “Services”).

By using the Services, registering you or your Enrollee for a Course, and/or affirmatively giving your agreement, you are agreeing on your own behalf and that of your Enrollee to abide and be bound by the Privacy Policy and the Terms and Conditions contained and referenced herein.

Online Courses

At Game-U we provide a multitude of online coding courses geared toward children. These Courses are primarily aimed at game design, but we also offer courses in robotics, art, and generalized coding.

If you are purchasing, or your Enrollee is participating in, an online Course, you agree on your own behalf and on behalf of your Enrollee to the following:

Course Offerings

We offer a variety of courses in many subjects. However, we do not guarantee the availability of or space in any individual course.

• Only Enrollees who are registered for the Course may participate.
• You agree not to allow more than one Enrollee to use an account simultaneously without separate registrations.
• Courses are taught in English unless otherwise specified.

Recording Policy

• Sessions may be video recorded for quality and safety purposes.
• Recordings are not shared publicly.
• In rare cases, recordings may be provided to law enforcement if safety concerns arise.

Game-U reserves the right to refuse enrollment for any reason, including:

• Past disruptive behavior
• Nonpayment of fees

Payment and Fees

• Payment is due at the time of sign-up unless otherwise specified.
• Fees are non-transferable and non-refundable, except at Game-U’s discretion.
• No refunds will be issued after the Course begins.

Payment Plans

• If you select a payment plan, you authorize automatic charges.
• Late payments:
  • 5 business days grace period
  • Possible removal from course
  • Possible late fees

No refunds, credits, or make-up classes will be provided due to missed sessions from delinquent payments.

Discounts

• Limited to one discount per Enrollee
• Must be applied at checkout
• No retroactive discounts
• Discounts cannot exceed total purchase cost

Equipment and Add-Ons

• Enrollees must provide their own computer and equipment for online courses.
• Game-U does not guarantee compatibility with your setup.
• Minimum system requirements should be reviewed beforehand.
• In-person classes include provided workstations.

Code of Conduct

Failure to comply may result in removal without refund.

Enrollees and parents/guardians may NEVER:

• Bully, harass, or intimidate others
• Use inappropriate language
• Share or display inappropriate content
• Share course materials without permission
• Impersonate others
• Contact instructors outside of class

Students may NEVER:

• Hack or engage in malicious activity
• Create accounts without permission
• Use false information
• Share personal information
• Record others without permission

Students and Parents MUST:

• Follow instructor directions
• Attend in an appropriate setting
• Dress appropriately
• Follow platform terms of use
• Share only relevant and appropriate materials

Special Accommodations

Requests must be submitted at least two weeks in advance.

Game-U will attempt reasonable accommodations but does not guarantee all requests can be fulfilled.

Reservation Changes

• Changes may be requested through the online portal
• Not guaranteed
• Subject to course-specific policies

Ownership

All content, materials, and intellectual property belong to Game-U.

Participation does not grant ownership rights.

General Releases

Media, Name, and Likeness Consent (Optional)

Participation in the Services does not require you to grant this consent, and declining will not affect your or your Enrollee’s access to any Course.

Separately from these Terms, you may choose to grant Game-U permission to capture and use photographs, video, audio, testimonials, name, image, and likeness of you or your Enrollee for marketing and promotional purposes. Any such permission:

• is given through a separate, clearly labeled media consent form that you affirmatively opt into;
• for any Enrollee under 18, must be granted by the Enrollee’s parent or guardian; and
• may be withdrawn at any time by contacting support@game-u.com, after which Game-U will cease further promotional use of the applicable materials (existing copies in third-party or already-distributed media may not be retrievable).

Software Accounts

• Accounts may be required for course participation
• You consent to account creation if needed

Game-U is not responsible for unauthorized accounts created by Enrollees without supervision.

Game Ratings

• Exposure to games rated T (Teen) or M (Mature) may occur
• Game-U attempts to minimize inappropriate exposure
• Participation assumes acceptance of this risk

Liability

Limitation of Liability

You agree to release Game-U from liability for:

• Injuries
• Damages
• Losses

Exception: This does not apply to gross negligence or intentional misconduct.

Indemnification

You agree to:

• Defend
• Indemnify
• Hold harmless Game-U

Against claims arising from participation.

Arbitration Agreement

• Disputes will be resolved through arbitration in New Jersey
• Governed by American Arbitration Association rules
• The prevailing party may recover legal costs

Rights Reserved

Game-U may:

• Modify Terms at any time
• Cancel or change courses or services

Additional Terms

• Message/data rates may apply
• Recurring messages may be sent
• Game-U is not responsible for carrier charges
• Anyone with phone access may see messages
